How Florida Title Insurance Rates Work (With Examples)

Florida title insurance premiums are set by state rule (Florida Administrative Code Rule 69O-186.003), not chosen by each title company: an owner’s policy costs $5.75 per $1,000 of coverage up to $100,000, then $5.00 per $1,000 from $100,000 to $1 million, and less above that. A $400,000 policy therefore has a premium of $2,075.

The owner’s policy rate schedule

The original (non-reissue) premium for an owner’s or a lender’s policy is built from these tiers of coverage amount:

  • $5.75 per $1,000 for the first $100,000
  • $5.00 per $1,000 from $100,000 to $1,000,000
  • $2.50 per $1,000 from $1,000,000 to $5,000,000
  • $2.25 per $1,000 from $5,000,000 to $10,000,000
  • $2.00 per $1,000 above $10,000,000
  • Minimum premium: $100 for a single conveyance

Worked examples

Owner’s policy premium at the original rate, with coverage equal to the price:

  • $250,000: $575.00 for the first $100,000 + $750.00 for the next $150,000 = $1,325.00
  • $400,000: $575.00 + $1,500.00 for the next $300,000 = $2,075.00
  • $600,000: $575.00 + $2,500.00 for the next $500,000 = $3,075.00
  • $1,000,000: $575.00 + $4,500.00 for the next $900,000 = $5,075.00

Lender’s policy, reissue rates and endorsements

When the owner’s and the lender’s policies are issued together on the same property, the rule sets a minimum premium of $25 for the lender’s policy up to the owner’s coverage amount. That is a floor: many agencies charge more, so ask what your agency charges.

A lower reissue rate can apply when a prior owner’s policy insured the seller, for example when the new policy is issued within three years of the earlier one. The title company confirms whether the property qualifies.

Several common residential endorsements carry a $25 minimum charge, and some, such as the Florida Form 9 endorsement, are priced as a percentage of the premium.

What the premium does not include

  • The title company’s settlement or closing fee
  • Search and examination, courier and similar service fees
  • Documentary stamp tax on the deed and on the mortgage note, and intangible tax on the mortgage
  • Recording fees

What this means when you compare title companies

Because the premium for the same coverage is the same everywhere, shopping on the premium alone will not save money. Compare the company’s own fees and how quickly and clearly they handle the closing.

Frequently asked questions

How much is title insurance in Florida for a $400,000 home?

The owner’s policy premium at the standard rate is $2,075.00 ($575.00 for the first $100,000 plus $1,500.00 for the next $300,000). A lender’s policy, a reissue credit and the title company’s own fees change the total.

Does the buyer or the seller pay for title insurance in Florida?

The owner’s policy is paid by the seller in many counties and by the buyer in others, and the contract can change it. The buyer pays for the lender’s policy when there is a mortgage.

Are Florida title insurance rates regulated?

Yes. The premium is set by rule (Fla. Admin. Code R. 69O-186.003), so it does not vary between title companies. Fees for services around the policy are not set by that rule and can vary.

What is a reissue rate?

A reduced premium that can apply when a recent earlier owner’s policy already insured the property, for example one issued within three years. Your title company confirms eligibility.
